Mandatory

Must be filed with the Bureau of Conveyances. The Hawaii Real Estate Commission (HREC) requires condos to register annually.

Retention: Permanent
Disclosure: Filed at the Bureau of Conveyances. Provided to any buyer at resale.

Condominium Disclosure Statement

HRS § 514B-87

Mandatory5 days

Must be provided to any buyer before a deposit is accepted. Must include: all governing documents, current budget, reserve study, and pending assessments. Buyer has 5 days to rescind.

Retention: 5 years
Disclosure: Provided to buyer before deposit. Buyer has 5 days to cancel.

Hawaii Real Estate Commission (HREC) Annual Registration

Mandatory

HRS § 514B-51

All condominium associations must register annually with the Hawaii Real Estate Commission (HREC) and pay a registration fee. Failure to register may affect the validity of resale disclosures.
