Massachusetts HOA Overview

Strong condo statute but no dedicated HOA statute for planned communities. HOAs are governed by their declarations and general law. The primary condo document is called a "Master Deed" rather than CC&Rs.

Master Deed

Mass. Gen. Laws Ch. 183A § 4

Mandatory

In Massachusetts, the primary governing document for a condo is called the "Master Deed" (not CC&Rs). It must be recorded at the county Registry of Deeds.

Retention: Permanent
Disclosure: Filed at the Registry of Deeds. Provided to any buyer at resale.

Resale Certificate

Mass. Gen. Laws Ch. 183A § 11

Mandatory10 days

Trustees must provide a resale certificate ("6(d) Certificate") within 10 days of written request. Certifies that all condo fees are paid.

Retention: 5 years
Disclosure: Provided to buyer within 10 days of request.

6(d) Certificate

Mandatory

Mass. Gen. Laws Ch. 183A § 6(d)

A certificate from the condominium trust certifying that all common expenses and assessments have been paid. Required for any resale closing. The "MA equivalent" of an estoppel certificate.
