New York HOA Overview
No general planned-community HOA statute. Condos are governed by the Real Property Law Condo Act. Co-ops are governed by the BCL. Planned community HOAs rely on their CC&Rs and BCL.

Condo declaration must be filed with the county clerk. Co-op offering plans must be approved by the NY Department of Law.

Resale Disclosure

Board of managers must provide a statement of unpaid common charges within 5 days of written request.
