New York HOA Overview

No general planned-community HOA statute. Condos are governed by the Real Property Law Condo Act. Co-ops are governed by the BCL. Planned community HOAs rely on their CC&Rs and BCL.

Declaration (Condo) / Offering Plan (Co-op)

N.Y. Real Prop. Law § 339-n

Mandatory

Condo declaration must be filed with the county clerk. Co-op offering plans must be approved by the NY Department of Law.

Retention: Permanent
Disclosure: Filed at county. Provided to any buyer at resale.

Resale Disclosure

N.Y. Real Prop. Law § 339-v

Mandatory5 days

Board of managers must provide a statement of unpaid common charges within 5 days of written request.

Retention: 5 years
Disclosure: Provided to buyer within 5 days of request.
