Virginia HOA Overview

Requires a formal "Resale Disclosure Packet" for all property sales. HOAs must register with the Common Interest Community Board (CICB). Developer must provide a "Public Offering Statement" for new communities.

Resale Disclosure Packet

Va. Code §§ 55.1-1809, 55.1-1810

Mandatory14 days

HOA must provide a complete "Resale Disclosure Packet" within 14 days of written request. Must include: declaration, bylaws, rules, budget, reserve study summary, insurance summary, pending violations, and disclosure of any outstanding assessments or pending litigation. Fee capped.

Retention: 5 years
Disclosure: Provided to seller (for buyer) within 14 days of request.

Notice of Meeting

Va. Code § 55.1-1815

Mandatory

HOA must provide at least 10 days written notice of annual and special meetings to all owners.

Retention: 5 years
Disclosure: Mailed to all owners at their address of record.

Annual Budget

Va. Code § 55.1-1825

Mandatory

Board must adopt an annual budget and distribute a summary to all members at least 14 days before it takes effect.

Retention: 7 years
Disclosure: Summary distributed to all members at least 14 days before the budget takes effect.

Common Interest Community Board (CICB) Registration

Mandatory

Va. Code § 54.1-2345

All HOAs and condos in Virginia must register annually with the Common Interest Community Board (CICB). Failure to register can result in fines and loss of lien rights.
