Washington HOA Overview

Budget must be "ratified" by owners each year; if the board adopts a budget that increases dues by more than 10%, owners can veto. RCW 64.90 (2018) is a modern UCIOA-derivative covering new communities.

Ratified Annual Budget

RCW 64.38.025

Mandatory

If the board adopts a budget that increases the regular assessments by more than 20% above the previous year, or imposes a special assessment exceeding 5% of the annual budget, the budget is subject to owner "veto" if a petition signed by 10% of owners is filed within 30 days.

Retention: 7 years
Disclosure: Distributed to all members within 30 days of adoption.

Reserve Study

RCW 64.34.382 (Condo)

Mandatory

Condos must maintain reserve studies and fund reserves. HOAs under RCW 64.38 are encouraged but not universally mandated to maintain reserve studies.

Retention: 10 years
Disclosure: Summarized in annual financial report distributed to all members.
Threshold: Mandated for condos (RCW 64.34); recommended for HOAs (RCW 64.38).

Resale Certificate

RCW 64.34.425 (Condo), RCW 64.38.045 (HOA)

Mandatory10 days

Must be provided within 10 business days of written request. Must include: declaration, bylaws, rules, current budget, reserve study summary, and disclosure of any pending assessments, violations, or litigation.

Retention: 5 years
Disclosure: Provided to buyer within 10 business days of request.

Owner Veto Petition

RCW 64.38.025

If the board adopts a budget increasing assessments by more than 20%, owners may file a petition signed by 10% of owners within 30 days to call a special meeting to veto the budget.

Triggered only when budget increase > 20%.
